1. What Content This Covers
This release applies to Content that includes your image, voice, or likeness, whether taken by:
- A professional photographer or videographer hired for the Trip;
- A trip host, guide, or creator leading the Trip;
- Other guests on the Trip;
- You, if you upload or share your own Trip photos or videos with Byline Travel (for example, through our app, a shared album, or by email); or
- You, if you upload a profile photo to your Byline account that was not taken during the Trip. We may display this photo to identify you as a guest who attended a Trip — for example, on a trip page, in a guest roster, or alongside a review.
2. Rights You Grant to Byline Travel
You grant Byline and its affiliates, successors, and assigns a worldwide, perpetual, royalty-free, non-exclusive, transferable, and sublicensable right and license to use, reproduce, edit, crop, and display the Content described above, in whole or in part, for:
- Marketing and promotional purposes, including our website, social media, email, advertising, and print materials; and
- Internal and product purposes, including our app, guest communications, and trip planning materials.
We may combine Content with other images, text, or video, and may edit it for length, format, or style. We are under no obligation to use any Content.
3. Guest Comments and Platform Feedback
3.1 What this covers
This section applies to written comments, messages, reviews, feedback, and other text you submit through Byline Travel's website, mobile applications, guest portals, messaging or concierge channels operated by Byline, and other technology platforms Byline provides or operates for guests (collectively, the “Platforms”), whether or not related to a specific Trip (“Guest Comments”). Guest Comments do not include photos, videos, or audio that are governed by Sections 1–2.
3.2 License
You grant Byline and its affiliates, successors, and assigns a worldwide, perpetual, royalty-free, non-exclusive, transferable, and sublicensable right and license, irrevocable except as provided in Section 7, to use, reproduce, excerpt, translate, edit for length or clarity, and display Guest Comments, in whole or in part, in connection with:
- marketing and promotional materials, including our website, social media, email, advertising, and print materials; and
- operating and improving the Platforms and guest communications.
We may combine Guest Comments with other text, images, or video. We will not edit a Guest Comment in a way that materially changes its meaning or presents your opinion as something other than what you expressed. We are under no obligation to use any Guest Comment. You keep ownership of your Guest Comments; this is a license, not a transfer.
3.3 Attribution
When we use Guest Comments in public-facing marketing (including on the website or in advertising), we may attribute them to you using your first name and the first initial of your last name as they appear on your Byline account (for example, “Alex K.”). We may also use a Guest Comment without attribution. We will not attribute a Guest Comment to you using your full name, photo, or other identifying details unless you separately agree in writing. If you would prefer a different display name, or no attribution, tell us at the address in Section 7.
3.4 Your representations
You represent that your Guest Comments reflect your own honest opinions and actual experience; do not include another person's private information, image, or name without that person's permission; and do not infringe any third party's rights or violate applicable law. If you received a free or discounted Trip, payment, or any other benefit from Byline or a Trip host in exchange for a Guest Comment, you agree to tell us so we can make any disclosure the law requires when we use it.
3.5 Your right to review us
Nothing in this Release limits your right to post honest reviews or comments about Byline, a Trip, or a Trip host anywhere you choose, including reviews that are critical of us. We will not penalize you for doing so.
3.6 Relationship to other terms
You remain subject to Byline's Traveler Terms regarding User Content. If there is a conflict between this Section 3 and the Traveler Terms solely with respect to Guest Comments used in public marketing materials, this Section 3 controls. To the extent permitted by law, you waive, or agree not to assert, any moral rights in Guest Comments to the extent needed for the uses described in this Section 3, and you agree that attribution as described in Section 3.3 satisfies any right of attribution you may have.
4. No Compensation or Credit
You will not receive payment, royalties, or credit for our use of the Content. You waive any right to inspect or approve the finished use, or to any claim for compensation arising from that use.
Section 4 does not limit our ability to attribute Guest Comments as described in Section 3.3. Section 4 otherwise applies only to Content under Sections 1–2.
5. Release of Claims
To the extent permitted by law, you release Byline, its affiliates, successors, assigns, licensees, employees, Trip hosts, and partners from any claims arising from the use of the Content or Guest Comments as permitted by this Release, including claims for defamation, invasion of privacy, false light, or infringement of moral rights or rights of publicity. This release does not cover uses that go beyond what this Release permits.
6. Guests Under 18
If you add a Guest under the age of 18 to your Trip application, you represent and confirm that you are that Guest's parent or legal guardian. By agreeing to this release, you are agreeing to it both on your own behalf and on behalf of that minor Guest, and you accept full responsibility for that representation. Your agreement on behalf of a minor Guest includes any Guest Comments the minor Guest submits through your account and any Guest Comments you submit that refer to the minor Guest. We will not attribute a Guest Comment to a minor Guest by name.
If you are not the minor Guest's parent or legal guardian, you may not agree to this release on their behalf. In that case, Byline requires a signed authorization from the minor Guest's parent or legal guardian before the minor Guest can be confirmed on the Trip.
7. Requesting Removal
You may withdraw your permission for future use of a specific piece of Content or a Guest Comment at any time by contacting us at privacy@byline.travel. Within thirty (30) days of receiving your request, we will stop new uses and remove the item from the digital properties we control (such as our website, app, and social media accounts). Withdrawal applies going forward only: material already distributed before we receive your request (for example, a printed brochure, an email already sent, or a copy shared by a third party) may not be recoverable, and this Release continues to cover those existing copies.
8. General
This Release is part of, and is governed by, Byline's Traveler Terms, including their governing law, dispute resolution, and severability provisions. Your electronic acceptance of this Release (for example, by checking a box when you apply for a Trip) is a valid electronic signature and has the same legal effect as a handwritten signature. The version of this Release you accept is the version that applies to you; if we make material changes, we will ask you to accept the new version before it applies to you. If any part of this Release is found unenforceable, the rest remains in effect.
